Accident Claims Forcing Up Insurance Premiums
Making a claim for a car accident is likely to increase premiums even when the accident occurs through no fault of your own. Car insurance policies include an excess to deter people from making trivial accident claims which cost the insurers millions of pounds.
When claims are made the insurers will then put up premiums to cover the costs and also deter people from making further claims in the future. In some cases the annual insurance premiums can double as a result of an accident claim. This system can seem particularly unfair if the accident was not your fault or if you have been a victim of crime such as theft. If your car insurer does increase your premiums you can always look around for a better deal with cheaper premiums. However there is very little you can do to protect yourself against other drivers on the roads that may cause the accidents in the first place.
Worryingly research conducted by USwitch has found that 33% of motorists in Britain do not know at what speed the national speed limit is set, and fourteen percent of people rely on road signs to inform them of the speed limit for the road they are on. Statistics show that drivers who exceed the speed limit cause over seven thousand accidents every year, of which fourteen percent are fatal. This is an incredibly high number. In addition the research found that more than half the people surveyed did not know who had priority if a set of traffic lights were to fail at a junction. The result of this is more accidents on the roads, which result in more claims for compensation and ultimately higher insurance costs.
Uswitch say that they estimate consumes are paying more that £845 million pounds extra as result of these claims. One reason for this might be the fact that insurance claims have increased in cost over the last five to ten years. It is estimated that there has been a twenty three percent increase in the average car accident claim payout since 2001, which amounts to £355 pounds. On average car insurers are now paying out over £23 million pounds a day for accident claims, which equates to just under one million pounds every hour. This is a staggering amount and makes it easier to understand why insurers increase premiums for drivers who make a claim. However perhaps if people drove more carefully on the roads this figure could be drastically reduced.
But driving more carefully may not be feasible as motorists do not seem to be aware of all the rules of the road. Most drivers take one test in the motoring lifetime, and that may have become a dim and distant memory some years on when they have developed their own perhaps less than perfect driving habits. As part of Uswitch’s research they tested motorists on basic driving theory and found that only one percent of the 2500 respondents answered all of the questions correctly. In addition eight percent of people got all of the questions wrong. It would seem until drivers are required to refresh their memory of important driving knowledge on a more frequent basis, accident claims are still likely to be made, meaning premiums are liable to rise in the future.

An Accidental Move Explaining Accident Claims
It is first necessary to distinguish what an Accident Claim is. If you have had a trip, slip, fall.
Or an accident at work or outside, then you are legally entitled to file for an accident compensation claim.
Understandably, if the accident occurs at work, some employees feel uncomfortable reporting against their employer.
However, any industrial injury compensation that you may recieve, once you have taken action, will not be paid directly from your employer.
If you feel that you do not wish to make a claim, then consider reporting the incident to your local Health and Safety Officer.
This may reduce the chances of a similar incident re-occurring. There are different types of claims that can be made.
There are ‘General Damages’. This is the legal term used for the compensation that is paid for physical injuries, pain, suffering and loss of amenity.
General damages, are difficult to assess as the cost value has to be placed on the suffering and pain an individual goes through.
Loss of earnings and a change of lifestyle due to an injury are all factors.
Therefore, the levels of a general damages claim differ as each case takes into consideration the variables.
Additional to the investigation, a medical expert may need to produce a written report on your injury, this is used as evidence, in turn assessing the value of your injury claim.
The courts decide the level of seriousness that the injury has caused, and uses other previous similar cases as a guideline for valuing compenstaion awards.
Another type of claim is ‘Special Damages’. This is the claim compensation for the financial loss due to an accident.
It is common that documentation is provided to use as evidence. For example, the claim of loss of earnings past and future, need to be supported by payslips and/or a P45 or P60 pre and post accident.
The claim of travel expenses to the hospital or doctors by car need mileage, dates and purpose of each journey.
Or by bus/train the purpose of the journey and ticket is required. There may be other things that you can claim for.
The best method to support your case, is to keep a record of all receipts and documents from the very beginning.
Slipping and tripping are a very common accidents. These may occur on a wet floor in a gymnasium or a supermarket.
For example boxes lying around.Pleasurable walks may be ruined by uneven drains or pavements.
It is therefore possible to file a claim against the party or person. However, if the trip or slip occured on a public path, footway or road, the matter needs to be dealt with by the Local Highway Authority.
Claims against this organisation are common, the actual claims are difficult to pursue.
This is because the government acknowlegdes that there are insufficient resourses to maintain the highways.
This supplies the authorities with a defence to personal claims, because if they display steps to maintain their roads such as inspections and repairs it is hard to prove otherwise.
The courts have supplied a general rule. If the ground is raised or unlevelled by less than 1 inch in height or depth, then this is considered not dangerous
However, this is only a rough estimate, so claims that are produced due to small defects do not have to be ignored.
There are also claims available for children, for example faulty playground equipment.
The normal time period to make a claim is within three years, but this differs with children.
If a child is 18years old or less when the injury happens, then the adult may construct a claim against the other party until the child is 21.
This is due to the courts reasoning that children under 18years old are not mentally sound to bring a case alone.
Whatever accident has happened, attention needs to be brought to it. It is paramount that you do not suffer alone.
That you are provided with the best service to help you with your claim.

Most Common Accident Claims
Accidents happen every day and result in thousands of people suffering personal injury every year. An accident injury can occur on the roads and footpaths, at work, in public places, at home, at school, during medical treatment and in many other situations but whatever the location, if the accident was caused wholly or partly by someone else, a right to compensation is likely to exist.
In many cases the accident and consequent injury is through no fault of the injured person but is caused by someone else. Some common types of accident claims which may occur are:
1. Road traffic accidents – injuries to vehicle occupants, pedestrians, cyclists
2. Accidents at work including industrial diseases
3. Accidents in public places
4. Injuries caused by defective goods or products
5. Medical or dental negligence
“Special Damages” is the term used to describe the compensation which can be recovered from the negligent party in respect of expenses or financial losses suffered as a result of an accident and which can be reasonably easily quantified. Examples of the types of items which may be involved are :
1. Loss of past earnings and assessed future earnings
2. Medical Expenses – past and future
3. Cost of nursing or other professional care – past and future
4. Gratuitous assistance eg unpaid help from family and friends
5. Prescription charges
6. Travelling expenses for attending hospital, doctor etc for treatment resulting from the accident
7. Costs of gardening, decorating, housework etc if you have to pay for this to be done because you are no longer able to do it yourself
8. Loss of or damage to your property
Obviously not all of the above will apply in every case and there may be other items depending on the individual circumstances of each claim.
In order to claim successfully it will be necessary to prove that the person was negligent and that the negligence caused the accident resulting in the injury. Where a claim is being pursued for specific items of financial loss or expense, satisfactory evidence will be required to support the amount being claimed.
Certain areas of claim such as pain and suffering, loss of future earnings, loss of amenity will normally be assessed by the court.
With certain exceptions a claim for personal injury compensation must be brought within three years of the accident. The main statute governing time limits is the Limitation Act 1980. The issue is complex however and there are situations where a shorter period may apply. Despite the three year period therefore you should contact a solicitor as soon as possible if you wish to pursue a claim.
Accident claims are complex, sometimes exceedingly so, and to pursue a claim you will need the services of a solicitor with particular expertise in this area. Making the right choice of solicitor is a matter you should take careful consideration over to make sure your compensation claim is handled effectively whether it is settled in or out of court.
Doing your homework will not only save you time but potential stress as well.

Accident Claims Solicitors in the UK
If you have suffered a personal injury due to someone else’s negligence then you are justified to make an accident claim to be rightfully compensated. The role of an accident claims solicitor is to claim all costs from the insurers of the individual responsible for your injuries. They are the key tools to help you financially recover from your accident. I’m sure you don’t want to be left to pay for medical expenses and the emotional trauma of an accident if you are not at fault. An accident claims solicitor will represent you and make sure you get compensated for the physical and emotional damage caused to you. Solicitors specialise in only certain areas so it is important to ensure you have a solicitor to represent you for accident and injury claims. Solicitors that are familiar with accident and injury claims will know what the current trends in the law are and the technical terminology to efficiently provide you the compensation you require. Hire a solicitor who is qualified and experienced to handle your case in a successful manner.
The accident claims solicitor will ask you to provide as much proof and evidence as possible, so it is important to be prepared. After a car accident occurs, take photographs, evidence and contact details of the other people involved in the accident so you can get adequately compensated for. The solicitor will need to see your medical reports to determine the amount of compensation you will have a right to demand from the person responsible. Solicitors are responsible for arranging a medical exam if you have not already obtained a medical report after the accident has occurred. It is vital to safeguard yourself from disaster by asking what will happen in the event of a loss. Solicitors in the UK follow “No Win, No Fee” policies that state your right to not have to pay any fees to the solicitor if they do not win the case for you. However, it is better to be careful and question beforehand what procedures are followed by the solicitor if the case is not won.
In the UK, you legally have 3 years to make a claim from a personal injury caused by someone else. This date starts from the day the accident occurred. Personal injury claims for soft tissue injuries are usually settled in about 6 to 9 months, while serious injuries take a longer time. The more serious and complicated the injury you want compensation for, the longer the process will take. Many people looking for compensation make the mistake of going directly to the insurer of the person responsible instead of going through a solicitor. By making this mistake, the insurer will take full advantage of the situation and will try to get rid of your claim as quickly and cheaply as possible. This means you might not get the amount of compensation that you actually deserve. So keeping everything in mind, ensure you hire the right accident claims solicitor and get full compensation for your injuries.
Accidents Direct has precisely the accident claims solicitor you are looking for, to provide you the assistance to file an injury claim and get the full compensation that you deserve.

Accident Claims, Being Prepared
Accidents happen in daily life, it could happen in all aspects of our lives be it in our work or personal lives. When accidents occur they can be costly because of the damage it might cause to the individual or their property.
For example accidents can cause loss of earnings depending on how long the victim is off work, most companies have a limit to the amount of time employees can get off due to sickness so taking off more time than stipulated by the company leads to non payment of wages hence a financial loss to the victim.
Also some accidents can bring about ongoing pain which might lead to physiotherapy and rehabilitation as well as the taking of painkillers which all cost money.
Some accidents also prevent you from doing activities which you would normally do not to mention the depression and misery you go through. For all these inconveniences you can make a compensation claim to make up for some of your loses and injuries.
Once you have decided to make a claim there are several companies available who will be more than happy to take on an accident claim, hundreds can be found easily via internet search engines and through television or radio adverts.
Before you take your case to a solicitor, you need to make sure you have three things which will determine whether or not your claim will be successful, First there has to be someone to claim from, this basically means for your claim to be successful someone has to be at fault. Your injuries should have been due to the negligence of another party; it could be a drunk driver crashing into you or your car, your company for failing to hire a competent janitor or workman which leads to your accident.
Secondly you must have documentation as proof of what happened and the resulting injuries from that incident. This applies to all injuries obtained during an accident; the whole point of making an accident claim is to get compensation for your pain and suffering and documentation shows exactly how much you have suffered. This is taken into consideration when compensation is awarded
Finally to make a successful accident claim you need to have evidence, of course accidents like car crashes, medical negligence and accidents at work normally have paper work to back them up but in other forms of accidents where the victim is the only witness best thing is to see your solicitor as soon as possible who will normally go back to the accident scene to examine it as well as take photographic evidence.
These several companies who specialize on a particular part or type of accident claims so getting someone to take up your case will not be a problem and thanks to competition in that sector these companies also work on a no win no fee basis so you don’t lose out regardless of the outcome of the case. It should also be pointed out that most accident claim cases rarely get to court; it is normally settled before it gets to that stage.

How to Make a Successful Car Accident Claim
Car accidents may all look the same, but the truth is they all have their subtle differences. Therefore, no car accident claim can be exactly like another. Accidents will always happen, there’s nothing to do about it; but if you are unfortunate enough to be a victim of such an accident you should know that a successful compensation claim must be carefully planned if you want to make it.
All Car Accidents Are Unique
But know this: there are so many companies that try to “help” in this kind of situation that you can’t always tell which are competent and which are not. Watch it for those men who intercept you seeing the accident or at the hospital. They work on commission so you can’t say they are as empathetic as they seem. So seeing the difference between a good company and a bad one will be a crucial thing before you act.
In most of cases, these people will want your injury claim. Even if it means by-passing the small print! Also important, you shouldn’t let them go on and on about their “successes”, cases won, claims delivered etc, because your situation is unique, and so anything can happen. They are paid to practically fool you, so don’t let them.
Then How Do You Make A Successful Car Accident Claim?
Car accident injury claims are one of the most important issues in their field. There is not much room for interpretation and the most important information can only be gathered at the scene. It is crucial for the victim to gather as much as he/she can, making notes about the driver and insurance, the place where it happened, how did it happen and most importantly how. If the police is present then things are simpler, because they know better what to look at and what questions to ask.
Passengers In A Car Accident
In most cases, passengers will not have any blame in an accident; they can be from either, the fault or non-fault side. But it wasn’t them who drove the car, so they have the greatest chances of success when asking for a correct compensation. Of course, they need to be checked by medical specialists for their injuries, otherwise there will be no claim. Passengers (no matter if husbands, wives, children or relatives) can make their car accident claim without any hesitation. Why should they suffer because of another persons’ negligence?
If you were the passenger and your driver messed up, you can still make your claim, it was his fault, you didn’t have anything to do with it. So no matter in which car you were when the accident occurred, you make a successful claim! But if you were the one who drove and it was indeed your fault, then there’s no chance at all you could make a claim. Only your passengers will be able to do that, against you.
Payment Factors
Do you know that there are some factors that will cut down the compensation payments you can receive? For example, if you weren’t wearing a seat belt, you will get less money, 25% less. What’s more, if the driver was drunk when it happened, you knew that he wasn’t in the right condition to drive and still you didn’t do anything about it then this will lower your payment by a certain amount.
There are cases where the driver admits part liability on a proportion basis. Generally it’s 50/50, but it needs to be assessed by an investigator who will examine who’s at fault before concluding. There are even some cases that result to 80/20.
Decision Dilemmas
You DO NOT need to hold back thinking it was your friend’s or family’s car. They pay insurance premiums every year to ensure if anything happens, they’re covered and so are their passengers. You also need to not worry if you were in a taxi, bus, train or any other form of public transport. You can still proceed with an accident compensation claim, as the drivers are insured, as is the taxi, train and bus driver. Companies pay thousands every year in insurance premiums to cover passengers for these unfortunate accidents and injuries.
On speaking to a quality car accident solicitor will you be able to eliminate doubts in your head about payments, fees and procedures!

Personal Accident Claim – What you Should Know!
A personal accident claim is quite a tricky thing to deal with. If you play your cards right, in a matter of a few months you will receive a nice accident injury claim cheque.
Do you remember those days when if you wanted to eat some cereals for breakfast your only choice was cornflakes? Those days are long gone, because now we can choose between many brands, like Crunchy Nut, Weetabix, Cheerios, and many others.
This is also the case of the accident compensation claims, now there are a great variety of choices available out there. Although lots of companies didn’t make it, there are still many that survived and became very well known.
Many companies though have become to use the words 100% Compensation, but the majority just want your business in exchange of giving you a tiny print to deduct charges. Of course, this thing is very unpleasant and many people are sick of it.
The idea is that you should get 100% Compensation for road traffic accident claims, work accident claims and slip, trip or fall claims. The others you may not receive 100% Compensation, mainly due to the structure of claim to recover costs.
It’s not hard to get your personal accident claim. Just apply and your accident solicitor will get the job done. That’s pretty much all you have to do. If the outset is well established, the rest will no longer be your concern.
The first part is the most important if you want this to happen. If you want to minimize the time factor and get your compensation as soon as possible, and get the full 100% Compensation, I recommend you follow this hint:
Stay In Contact With Your Accident Claim Solicitor
Never lose sight of your claim solicitor. If you must go away for days or for any other reason you can’t be reached on the phone then make sure the know about it. That’s because there were some cases when some individuals failed to inform their injury solicitor and thus the accident injury claim had gone to rust in the archives. So be careful and avoid this. The more active and cooperative you are, the faster you’ll get your cheque.
Is that simple or what?
